Management Basics and the Manager Job Role

Management Basics and the Manager Job RoleManagement Basics and the Manager Job RoleWhat is management? What do managers do? How do I manage? These are standard questions that most of us in the management profession have been asked more than once and they are questions we asked once in our careers, too. Here is a basic look at management- a virtual Management 101. Art and Science Managementis both an art and a science. It is the art of making people more effective than they would have been without you and there is a science to how you do that. There are four basic pillars of the managers role plan, organize, direct, and monitor. Maximize Effectiveness To illustrate the benefits of an effective manager, consider this scenario Four workers can make 6 units in an eight-hour shift without a manager. If you are hired to manage them and they still make 6 units a day, what is your benefit to the business? On the other hand, if they now make 8 units per day, you- as the manager- have value. The same analogy applies to service, retail, teaching, or any other kind of work. Can your group handle more customer calls with you than without? Sell higher value merchandise? Imparte knowledge more effectively? That is the value of management- making a group of individual workers more effective. Plan If management starts with planning, good management starts with good planning. Without a plan, you will never succeed. If you happen to make it to the goal, it will have been by luck or chance and is not repeatable. You may make it as a flash-in-the-pan- an overnight sensation- but you will never have the track record of accomplishments of which success is made. Figure out what your goal is, or listen when your boss tells you, then figure out the best way to get there. What resources do you have? What can you get? Compare the strengths and weaknesses of individuals and other resources. Look at all the probable scenarios and develop a plan for them. Figure out the worst pos sible scenario and plan for that, too. Evaluate your different plans and develop what, in your best judgment, will work the best and what you will do if it doesnt. TIPOne of the most often overlooked management planning tools is the most effective. Ask the people doing the work for their input. Organize Now that you have a plan, you have to make it happen. Is everything ready ahead of your group so the right stuff will get to your group at the right time? Is your group prepared to do its part of the plan? Is the downstream organization ready for what your group will deliver and when it will arrive? Find out if your workers are training and motivated and if they have the necessary equipment for following through on your plan. Your plan should include solutions for any eventuality, so prepare to have the necessary spare parts for the equipment. Enaya that purchasing has ordered the material and it is the right stuff and it will arrive in time to keep your plan on schedule. Do the legwork to make sure everything needed to execute the plan is ready to go or will be when it is needed. Check back to make sure that everyone understands their role and the importance of their role in the overall success. Direct Everything is in place and it is now time to flip the ON switch- tell people what they need to do. We like to think of this part like conducting an orchestra Everyone in the orchestra has the music in front of them and they know which section is playing which piece and when. They know when to come in, what to play, and when to stop again. The conductor cues each section to make the music happen- thats your job here. Youve given all your musicians (workers) the sheet music (the plan), you have the right number of musicians (workers) in each section (department), and youve arranged the sections on stage so the music will sound best (you have organized the work). Now you need only to tap the podium lightly with your baton to get their attention and give th e downbeat. Monitor Now that you have everything moving, you have to keep an eye on things. Make sure everything is going according to the plan and, when it isnt going according to plan, step in and adjust the plan. Problems will come up- someone will get sick a part wont be delivered on time a key customer will go bankrupt- but that is why you developed a contingency plan in the first place. You, as the manager, have to always be aware of whats going on so you can make any necessary adjustments. Monitoring is an iterative process- when something is out of sync, you need to plan a fix, organize the resources to make it work, direct the people who will make it happen, and continue to monitor the effect of the change. A Rewarding Experience Managing people is not easy however, it can be done successfully and it can be a very rewarding experience. Remember that management, like any other skill, is something that you can improve at with study and practice.

The environment effect Why so few people succeed and others dont

The environment effect Why so few people succeed and others dontThe environment effect Why so few people succeed and others dontOn November 16, 1532, Inca emperor, Atahuallpa, and invading Spanish conquistador, Francisco Pizarro, set eyes on one another for the first time, at the Peruvian highland town of Cajamarca.1Atahuallpa had a huge home advantage. He was the monarch of the largest and most advanced state in the New World, ruled an empire of millions of people, and was surrounded by an army of 80,000 soldiers on home soil.Pizarro on the other hand, led a group of 168 Spanish soldiers into the unfamiliar terrain of Atahuallpas empire, far away from reinforcements. The odds were heavily stacked in Atahuallpas favour, as he was on home soil, and his 80,000 soldiers significantly outnumbered Pizarros 168 men.Shortly after, the Indian soldiers would defeat the Spanish invaders, in a one-sided battle.Or would they?Within a few minutes of the first encounter between the two leaders, Piz arro captured Atahuallpa, and his soldiers slaughtered over 7,000 Indian troops, in what was the bloodiest massacre of indigenous people during the early Colonial era.Several months later, Pizzaro executed Atahuallpa, and the Spaniards conquered the entire Inca Empire. The victory of the Spanish forces over the Inca empire, marked the beginning of widespread European colonial success across the Americas and Africa. How did such a small number of Spanish soldiers succeed in defeating the vastly more numerous Inca empire? Why did the Europeans succeed in colonizing the rest of world, and dominate in every aspect of prosperity and economic development, instead of the Americans or Africans? Most importantly, how does this explain why today, so few people reap the rewards and achieve success at the highest level?Lets dive in.Why Jamaican sprinters run so fastAt the 1952 Olympics in Helsinki, Finland, Jamaica was ranked 13th in the world, winning just two gold medals in 400-meter track event s.By the 2008 Olympics in Beijing, Jamaica dominated the sprint events in 100 and 200 meters a clean sweep, with Usain bolt winning three gold medals, and Veronica Campbell-Brown winning one gold medal in Womens 100-meter dash.At first glance, it may seem to be a coincidence that Jamaica, an island of only 2.8 million people, is the sprint factory of the world. And that a disproportionate number of its sprint champions would happen to be born in the parish of Trelawny, north of Jamaica.2But is itreally? Each year, Jamaica hosts a national high school track-and-field championship called Champs.Champs is screened live on national television, and extends over four days with the best athletes from 120 schools competing against one another. The event takes place in Kingstons 35,000-seat National Stadium, which often sells out, and has attendances much larger than those of professional track events.During Champs, scouts keep their eyes peeled for the next sprinting superstar of the world, a nd young athletes have the opportunity to change their fortunes, through scholarships or endorsements. Its the culmination of several years of sprinting under the Jamaican youth system. And much like the youth system of football in the United States, or soccer in Brazil, nearly every kid in Jamaica would have been made to sprint at some point in youth races, from as young as five years old.A child born in Jamaica would have the following stacked in their favor a school system that encourages high level sprint training and competition from a very young age, a warm climate that enables sprinting outdoors all year round, a culture that reveres and rewards sprinting, and high level facilities, coaching and equipment.By the time high school athletes participate in Champs, they have had over 10 years worth of practice in sprinting, and are miles ahead of their counterparts in other countries. So, is it that much of a surprise that Jamaican sprinters run much faster than their competitors, an d dominate sprint events on the professional level? This brings us one step closer to solving the puzzle of why so few people succeed in life and work. The power of locationBack to the battle of Cajamarca. Why did Pizarro succeed in capturing Atahuallpa and defeat the vastly more numerous Inca army?A basic answer is this Pizarro and his men had the military advantage of using steel swords, armor, guns, and horses, that Atahuallpas troops didnt. This distinct advantage enabled the Spanish soldiers to kill thousands of natives, who could only defend themselves with stones, slingshots and wooden clubs. But this answer is too simplistic. It doesnt answer the real question beneath the surface why did the Spaniards and Europeans first come to have these military advantages for colonization, instead of the natives in America or Africa? To answer this question lets have a look at the map of the worldDiagram of the major axes of the continents via Guns, Germs and Steel.Do you notice anything stra nge in the image above? The major axis of the Americas is north-south, likewise in Africa. But, in Eurasia, its east-west.In addition, Eurasia has the largest landmass of all three continents. In the best-selling book,Guns, Germs and Steel(Audiobook), historian and geographer, Jared Diamond, argues that these geographical differences in the continents, affected the diffusion of food production and inventions, and contributed to the significant differences in development of the Native Americans, Africans and Eurasians. For example, Eurasias east-west major axis, enabled the rapid spread of the newly invented wheel in 3,000 B.C., from Southwest Asia to the rest of Eurasia within a few centuries.Conversely, Americas north-south axis, prevented the spread of wheels invented in Mexico to the Andes region.Likewise, in Sub-Saharan Africa, the north-south axis and the major ecological barrier of the Saharan desert, prevented the spread of writing, which developed in Egypt in 3,000 B.C., and di d not spread independently to the rest of Africa until it was introduced by Arabs and Europeans, centuries later.Unlike Africa and the Americas, Eurasia had moderate ecological and geographical barriers. The east-west major axis permitted ease of movement of crops and livestock, which in turn enabled food production in abundance, a larger, healthier population, more competing societies, more inventors, and better innovations, than anywhere else in the world. The answer to the puzzling question of why Pizarro successfully led a tiny army of soldiers to defeat Atahuallpas Inca empire, is simple Pizarro was born and raised in Eurasia. He enjoyed the benefits of living in the most developed, prosperous and advanced society in the world, including the military innovations that helped his soldiers to conquer the Inca empire. In other words, if Pizarro and Atahuallpa, were interchanged in where they had been born, Atahuallpa would have defeated Pizarro. So, how does this all tie back to solve t he puzzle of why so few people achieve success in life and work?Long story short, successful people live in an optimal environment that enables them to develop the right skills, mindset and tools, required for success. And because success is subjective based on comparison to others, the optimal environment creates distinct competitive advantages that result in only a few people reaping most of the rewards. This is why Jamaican sprinters dominate sprint events, and Europeans achieved much more developmental success than Africans and Americans. Its not because of their distinctive human intellect, genetics or work ethic, ratherits because of their environment.Design your luckThere is a strange phenomenon sociologists have observed. Its called the Matthew Effect, named after the New Testament verse in the Gospel of Matthew3For unto everyone that hath shall be given, and he shall have abundance. But from him that hath not shall be taken away even that which he hath. - Matthew 2529The Matt hew Effect suggests that people who have a distinctive head start or advantage over others by chance or luck, are the most likely to be given more opportunities that breed greater success. And vice versa. As weve discovered, that distinctive advantage is environment. There are very few people in the world lucky enough to live in the right place, at the right time, surrounded by the right people and resources, required to achieve the success they desire. This is why the top athletes tend to come from the same regions of the world. Its why Eurasia survived, conquered and dominated the world, and Americas or Africa didnt. And ultimately, its why so few people succeed and others dont. The romantic idea that success is a byproduct of hard work alone is too simplistic, and fails to take into account the role of environment.Environment is the hidden force that shapes our lives. Where you live and the people you surround yourself with, will ultimately determine the destiny of your life. But you d ont have to leave this to chance. You have the power to step outside of your comfort zone, and change your environment to work for you, instead of against you.You have the power to surround yourself with people who will support your goals and improve your odds of success, and distance yourself from those who dont.In the end, only you have the power to design your luck.Mayo Oshin writes atMayoOshin.Com, where he shares the best practical ideas based on proven science and the habits of highly successful people for stress-free productivity and improved mental performance. 4 ways top leaders can build resilience in their teams

4 ways top leaders can build resilience in their teams4 ways top leaders can build resilience in their teamsWork can be a gratifying distributions-mix where people are able to extend themselves, overcome challenges, and find purpose and belonging. Yet despite the potential for work to contribute to individual growth and development, it often falls short of these aspirations.Today, stress in the workplace is a growing concern for both employees and their employers. This is theresult of changes including thedecline of manufacturing in several countries, and downsizing and the resulting lay-offs.The increased use of mobile phones, laptop computers, and PDAs often means that employees dont ever really leave work, which can limit downtime to recover from workplace stress.Too much stress can have a negative effect on employee resilience, the capacity to bounce back quickly from stressors and adversity. So how can we ensure thatwork is a place of flourishing, rather than a place where indivi dual resilience is eroded? The answer could lie with managers. Here are four ways managers can supportthe resilience of employees.1. Reduce unnecessary obstaclesHindrance stressors are workplace demands that can impede goal achievement or personal development. A good example of a hindrance stressor is bureaucracy or considerable administration that is a barrier to actual work outcomes.Research thatI didin 2016 with Ben JosephSearle demonstrated thathigh levels of hindrance stressors have the potential to erode the degree that employees see themselves as resilient over a period as short as three months.Managers often underestimate the impact that these frustrating stressors have on employees lives and wellbeing. They also may not considerhow changes thatincrease the amount of administration or red-tape can negativelyaffect employees. These stressors should be identified, minimized, or removed all together. Managers need to play an important role in protectingtheir employees from hindra nce stressors. They should seek to identify improvements to processes and question the need for excessiveadministration.2. Promoteadaptive behaviorsHow managers respond to setbacks is another critical aspect of managing for resilience. A managers response can either be a model for building resilience or eroding it.When managers showresilient behavior and thinking, they caninspire it in others. These behaviors and thinking styles might includepromoting optimism and agency about the achievement of organizational goals, celebrating success, and promoting learning from, but not dwelling on, failure.3. Develop a sense of purpose and belongingManagers are in a unique position to develop a collective sense of purpose, cohesion, and belonging among their team members.Organizational psychologists have described the benefits of organizational belonging during times of organizational change. Research has also shown that the more resilient families tend to promote family cohesion, celebrate fam ily events, develop a culture of their own, support and advocate for one another, and display good communication. You can probably think of a manager you have worked with whowould ventabout other team members. Now consider the impact this had on you and the people you worked with. In contrast, a manager who is willing to celebrate team success or sincerely takes on feedback appears to have only positive effectson the employees in their charge.4. Give employees what they need to cope with the demands of their rolesManagers need to be willing to ask, listen, and respond to the strategies that employees believe will help them to cope. Access to coping resources can be many and varied and may be as simple as allowing employees greater flexibility in their work schedule so that they can respond to the stressors in their personal lives, or take breaks when needed. This point reflects thefrequent observation among psychologists that most people are resilient and have an aktion understanding ofhow they can adapt to the challenges they face.Although employee resilience can at times seem insurmountable, making the nurturing of resilience part of a managerial roleshows a positive way forward.Dr. Monique Crane isa lecturer in Organisational Psychology at Macquarie University, Sydney, Australia and the editorof Managing for Resilience A Practical Guide for Employee Wellbeing and Organizational Performance.

You (the Grantor) can be the Trustee and Beneficiary of your own Living Trust, and retain management control over your own property. What are the benefits of a Revocable Living Trust over a brde Will (probate court)?Probate court will mean additional expenses, delay, and loss of privacy. A Revocable Living Trust should help you avoid many of the expenses and delay of Probate Court. Your beneficiaries will usually have unrestricted and uninterrupted access to income and assets after your death as long as you do leid have significant unresolved debts. Note also that Probate Court is a public record with a resulting loss of privacy. In addition a Revocable Living Trust can be set up to smoothly manage your afritterlichs in case of temporary disability. What are the drawbacks of a Revocable Living Trust?A Living Trust can be mora trouble to set up and maintain or modify. Title to all property must be individually transferred to the trust including land, accounts and securities. You will probably still need a simple Last Will to distribute any remaining possessions or cash not contained in your Living Trust. How does a Revocable Living Trust work? When a trust is created, a Trustee must be appointed to manage the trust. With a Revocable Living Trust, you (the Grantor) are alfruchtwein always the Trustee as well as the initial Beneficiary as long as you are alive. When you (the Grantor/Trustee) die, then the duties and obligations of managing the trust shift to the Successor Trustee. At the time of your death the trust is no longer revocable and the terms of the trust can no longer be changed. If I set up a Living Trust can I be my own trustee?Yes. In fact it is very common for a grantor to act as their own trustee. One of the benefits of a Living Trust is that the grantor can retain control over their own property for the rest of their lives. You must however designate a Successor Trustee who will take over management of your Living Trust after you die.So if I create a Living Trust then I dont have to worry about probate? Not true. Any property that you do not transfer to your trust will still be subject to probate. You must ensure that you have transferred as much property as possible into your Living Trust including bank accounts, investment accounts, real estate, and business interests. If you have substantial debts and obligations then probate may also be advisable to limit creditor rights, and limit the time that your Revocable Living Trust can be challenged. Probate may also be required to establish homestead position for your primary resid ence. Are there other ways to avoid probate? There are other ways to avoid the expense and delay of probate. By holding property jointly (with rights of survivorship) with your spouse or partner the surviving spouse or partner simply assumes full title to joint property on your death. In addition, in the case of life insurance policies and retirement accounts, assets may be directly transferred without probate by naming specific beneficiaries in the policy. You may also avoid probate by simply making a gift of property before your death. However, you cannot do this for the purpose of hiding assets or avoiding debts as a court may find this to be a fraudulent conveyance and may reverse or void the gift. Will beneficiaries have instant access to my assets and property after my death? No. The trustee must first ensure that all legally enforceable debts and obligations of the grantor are resolved. Only then can the trustees make a final distribution of the trust assets and property. Is a Tes tamentary Trust the same as a Living Trust? No. A Testamentary Trust is created by a Last Will and Testament on the death of the grantor. A Living Trust is created during the lifetime of the grantor and therefore can often be managed by the grantor acting as trustee. A Living Trust becomes effective as soon as it is created. A Testamentary Trust is created on the death of the grantor. What is the difference between a revocable and irrevocable trust? An Irrevocable Trust is permanent and cannot be revoked or amended even by the grantor and the property assigned to the Irrevocable Trust cannot be returned to the grantor. A Revocable Living Trust can be amended or revoked by the grantor during the lifetime of the grantor. Once a grantor dies then a Revocable Trust becomes an Irrevocable Trust and a successor trustee will assume management of the trust. An Irrevocable Trust may have tax advantages over a Revocable Trust where the Irrevocable Trust will be treated as a separate taxable enti ty however gifts made to an Irrevocable Trust may still be included in determining the value of an estate for estate tax purposes. Are there any benefits to probate court?Anyone with a claim against your estate has up to two years to file a claim. That could mean that your trustee may not want to distribute assets to your beneficiaries until two years has expired. Probate court has a specific claim process and probate law limits the period for filing claims to a much shorter period usually only 3 months after the first publication of the notice to creditors. Probate court also has a voreingestellt process for objecting to claims. What happens if I dont have a Last Will or a Living Trust? If you do not have either a Last Will or Living Trust then upon your death the probate court in the state where you die will apply standard rules to distribute your property and assets among your surviving spouse and family. These standard rules may not provide the best result for the requirements of your family. In addition, a court may select a guardian for any minor children and that guardian may get control of the property and assets that belong to that minor child. Is a Revocable Living Trust right for me?How do I know I need a Living Trust?Whether a Living Trust is the best fit for you depends on your personal circumstance. If you are young and healthy and have only modest assets, it may be that a Last Will is an adequate solution for your needs. Anyone who is concerned about the distribution of their estate may want to have court supervision over the administration of their estate and would therefore prefer probate court. You must also find an individual that you trust to act as trustee over your property for a potentially long term commitment. If you are uncertain about what is the best solution for your situation then you may wish to obtain qualified legal advice.I am married and our property is jointly held. Do I need a Living Trust?Where property is jointly held betwe en husband and wife, probate will not usually be necessary for those assets because title to those assets will automatically transfer to the surviving spouse. However an older couple may wish to create a Revocable Living Trust with both spouses acting as co-grantors and co-trustees. Of course if you are concerned about privacy then you may wish to create a Living Trust anyway. If you are uncertain about what is the best solution for your situation then you may wish to obtain qualified legal advice.I am young-ish and have only modest assets. Do I need a Living Trust? If you are young and healthy and expect to live a long time then a Living Trust may be a clumsy way to manage your assets on an ongoing basis. In this case a Last Will is probably adequate. If you are young but have substantial assets then you may not want to take a chance, in that case you may still want to create a Living Trust to ensure that probate costs are minimized in the event of your untimely death. Of course if you are concerned about privacy then you may wish to create a Living Trust anyway. If you are uncertain about what is the best solution for your situation then you may wish to obtain qualified legal advice.I think estate taxes may have to be paid on my estate. Will a Living Trust help me reduce my taxes? If the fair market value of your estate is greater than the available unified credit (currently $1,000,000) then your estate will have to pay estate tax on the amount greater than the credit. For example, if the fair market value of your estate is $1,400,000 then federal estate tax would be due on $400,000. Giving away part of the value of your estate to a Revocable Living Trust does NOT help you reduce the fair market value of your estate. A Living Trust is not a tax loophole. If you are confused by any of this or if the fair market value of your estate is greater than the available credit (currently $1,000,000) then you should seek qualified legal advice. TrusteesWhat are the advan tages of a Corporate Trustee?A Corporate Trustee (bank or trust company) avoids the issue of losing a trustee because of death, incapacity or resignation of an individual trustee. This can be especially helpful if the trust will be required for an extended period. If you are having trouble deciding on a reliable trustee then a Corporate Trustee can be an option. A Corporate Trustee may be more experienced in money management and investing than a family member. What are the disadvantages of a Corporate Trustee?A Corporate Trustee may charge more to manage your trust than a family member would charge because a Corporate Trustee will be more experienced in money management and investing than a family member. If you are dissatisfied with the performance of a trust it may be difficult to get rid of a Corporate Trustee. A Corporate Trustee only has to show the court that their investments were reasonable. Usually there would have to be a serious breach of trust before the courts would act to remove a Corporate Trustee. In addition, a Corporate Trustee will use your own trust funds to fight you in court. A Corporate Trustee may simply invest your money in their own mutual fund. In this case you will be charged for mutual fund management fees as well as trust fund management fees. This will use up a considerable portion of the income of your trust fund but would probably be considered reasonable by a court.TaxesDoes a Living Trust help avoid taxes? No. A Revocable Living Trust is not a loop-hole in the tax law. A well structured Living Trust is no different than a well structured Last Will for minimizing taxes. Income earned by property in the Living Trust will be taxable annually as income tax in the name and social security number of the grantor (Thats you). In addition, on your death, estate taxes may also be payable out of the assets of your Living Trust. In fact, upon your death, your Successor Trustee is obligated to provide notice of the existence of your Living Trust. If the assets controlled by your Last Will are insufficient to pay your outstanding debts and obligations, then the personal representative of your Last Will is entitled to receive payment out of your Living Trust to satisfy any of your outstanding debts and obligations.Who pays taxes on the income earned by the trust? The grantor retains title to the trust property during his or her lifetime. The grantor therefore is responsible for paying tax on any income earned by the trust while the grantor is alive. So what about those estate taxes? When you die, federal estate taxes may be payable depending on the fair market value of your estate. Some states may also charge an estate tax. If the fair market v alue of your estate is greater than the available unified credit (currently $1,000,000) then you should consult a qualified lawyer in your jurisdiction to help you minimize your estate tax burden. The value of your estate will include the fair market value of all assets, the value of any previous gifts plus the proceeds of any life insurance policies. Are there any exemptions to estate tax?Exemptions exist that protect at least a portion of your estate from estate tax. However, homestead property held in a Living Trust may not be provided creditor protection under bankruptcy law. Consult a qualified legal professional if you are not certain how to proceed.Protection against creditorsDoes a Living Trust protect my assets against creditors? No. A Revocable Living Trust is NOT a loop-hole to help you avoid creditors. This includes the payment of all legal debts of the deceased and the subsequent distribution of the remaining es tate assets among beneficiaries. Remember A Revocable Living Trust is NOT a loop-hole to help you avoid creditors. Note also that all your property does not have to go through probate. Any property that is jointly owned with rights of survivorship, such as your house which is usually jointly owned with your spouse, will automatically pass to the surviving joint owner. Life insurance policies, annuities, and retirement plans all with a valid designated beneficiary would transfer directly to the beneficiary and would not go through probate. What is a Grantor?A Grantor (also known as settler or trustor) is the person who creates the trust and contributes most or all of the assets or property to the trust. What is a Trustee?A trustee is the person or persons who actively manage the trust property for the benefit of the beneficiaries. The trustees are allowed to manage the trust property substantially as if it was their own however actual title to the property would remain in the name of the grantor while the grantor is still alive otherwise title to the property is held in the name of the trust. The trustee is usually paid a fee for managing the trust property. What is a Successor Trustee?A successor trustee will be the person or persons who take over the management of the trust upon the death of the grantor or if the grantor becomes incapacitated and is unable to manage their own affairs. During the lifetime of the grantor the Living Trust may be managed by the grantor himself, however a trustee (the successor trustee) must be identified who will take over the management of the trust after the death of the grantor. What is a Corporate Trustee?A corporate trustee is a company such as a bank or other financial institution that provides professional services for the management of trusts. A corporate trustee is often more objective and has more investment experience than a family member however you may appoint both a corporate trustee as well as an individual person to act jointly to manage your trust. You can expect a corporate trustee to charge a substantial fee for their services. Despite the extra cost, a corporate trustee has some distinct advantages. A corporate trustee is experienced in investment management and will continue to act indefinitely whereas a person acting as trustee may wish to quit eventually or may become sick or incapacitated or die. What is a Beneficiary? The beneficiary is the person or persons for whom the trust is for. After the death of the grantor, the trustee will divide the trust property among the beneficiaries in accordance with the terms of the trust. What is a Pour-Over Will?A Pour-Over Will is used to transfer all remaining property of the estate into the Living Trust. This simply ensures that all remaining property is transferred into the trust. The Pour-Over Will must still go through probate before property can be transferred to the trust.MiscellaneousIf I have a Living Trust do I also need a Last Will?Yes. You should still make a Last Will to distribute all the assets and property not held in your Living Trust. It is unlikely that you will be able to transfer all property into your Living Trust. Cars, personal property, checking accounts, debts owed to you, or even an outstanding income tax refund could all be sitting outside your Living Trust when you die. Whatever is left of your estate including all property that was not transferred to your Living Trust will be distributed through your Last Will. But if you minimize the amount of property held outside your Living Trust you should be able to minimize the costs and delay of probate and maximize your privacy. What happens if a Grantor takes up residence in a different state? As long as the original Living Trust was properly created according to the requirements in the original jurisdiction, it will be accepted as valid in other states. How should I describe my property?Provide an accurate description of the assets you wish to transfer to yo ur Living Trust. Include account numbers and serial numbers as well as a thorough description where possible. Include a proper legal description for any real estate to be transferred.
